Acceptance of these terms
These Terms of Service ("Terms") govern your access to and use of the website at unlisted.llc (the "Site") and any sample materials, content, and inquiry channels provided through it. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms govern use of the Site. Paid security review engagements are governed by a separate written agreement between you and Unlisted Security. In case of conflict, that engagement agreement takes precedence over these Terms with respect to the engagement.
About Unlisted Security
Unlisted Security is a technical security firm that provides smart contract audits and adversarial security reviews for smart contracts, backend systems, infrastructure, and full-stack applications. References to "Unlisted Security," "we," "us," or "our" refer to the legal entity operating under that name.
Use of the Site
You may use the Site for lawful, informational, and inquiry purposes. You agree not to:
- Use the Site in violation of any applicable law or regulation.
- Attempt to disrupt, overload, or interfere with the Site or any systems connected to it.
- Reverse engineer, scrape at scale, or attempt to bypass any access or rate-limiting controls of the Site, except to the extent expressly permitted by law.
- Use the Site to transmit malware, phishing content, or any unlawful or harmful material.
- Use the Site to harass, defame, or impersonate any person, including Unlisted Security personnel.
We may suspend or block access to the Site (in whole or in part) for any user we believe is violating these Terms or putting the Site at risk.
Good-faith security research. If you believe you've found a vulnerability in the Site itself, please report it privately to contact@unlisted.llc. We will not pursue legal action against good-faith researchers who report vulnerabilities responsibly and do not access, modify, or exfiltrate data beyond what is necessary to demonstrate the issue.
Intellectual property
The Site, including its design, code, copy, illustrations, and the "Unlisted Security" name and logo, is owned by Unlisted Security or its licensors and is protected by intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, sell, or create derivative works from the Site or its contents.
You may quote short excerpts of public content from the Site for commentary, journalism, or non-commercial reference, with attribution to Unlisted Security.
Sample report and illustrative content
The Site may include sample content — including a sample engagement report — provided for illustrative purposes only. All clients, projects, identifiers, and findings in sample content are fictional. Sample content does not represent any real client engagement or any real vulnerability in any real system, and should not be relied on for any operational, security, or investment decision.
Engagements and proposals
Submitting an inquiry through the Site (or any other channel) does not create a contract or any obligation on either party. A security review engagement begins only when both parties have signed a written engagement agreement specifying scope, deliverables, fees, timing, and other terms.
Until a signed engagement agreement is in place, any communications and proposals exchanged are non-binding, except for confidentiality terms that may apply by separate agreement (such as a mutual NDA).
Confidentiality
We treat information you share with us in connection with a potential or actual engagement as confidential, regardless of whether a formal NDA has been signed yet. We do not name clients publicly or describe specific engagements without explicit written consent.
For any active engagement, the confidentiality terms in the signed engagement agreement and any associated NDA control.
No warranty; no security guarantees
The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law. We do not warrant that the Site will be uninterrupted, error-free, or free from harmful components.
Security review services, when engaged under a separate written agreement, involve a professional, manual review by skilled reviewers — but no security review can identify every possible vulnerability. We do not warrant that a system reviewed by Unlisted Security is free of vulnerabilities, immune to attack, or otherwise "secure." The conclusions and recommendations in any deliverable are based on the scope, time, and information available during the engagement.
Limitation of liability
To the maximum extent permitted by law, Unlisted Security and its personnel will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising from or related to your use of the Site, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising from or related to your use of the Site will not exceed one hundred U.S. dollars (USD 100). For paid engagements, the liability terms in the relevant engagement agreement control instead of this section.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of these limitations may not apply to you. Nothing in these Terms limits any liability that cannot be limited under applicable law.
Indemnification
You agree to indemnify and hold Unlisted Security and its personnel harmless from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorneys' fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or third-party right in connection with your use of the Site.
Third-party links and references
The Site may include links or references to third-party websites, tools, or documents. We do not control, endorse, or assume responsibility for any third-party content. Your use of any third-party service is at your own risk and subject to that third party's terms.
Governing law and disputes
These Terms are governed by the laws of the jurisdiction in which Unlisted Security is registered, without regard to its conflict-of-law principles. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising from or related to these Terms or your use of the Site, except where applicable law requires otherwise.
Engagement-specific disputes are handled under the terms of the relevant engagement agreement.
Changes to these terms
We may update these Terms from time to time to reflect changes in our practices, our services, or applicable law. When we do, we'll update the "Effective" date at the top of the page. Your continued use of the Site after any update constitutes acceptance of the updated Terms.
